EDITION SPECIALE ? Au titre de la «lutte contre le piratage des ?uvres culturelles», le projet de loi sur le droit d'auteur en discussion à l'Assemblée nationale le 20 décembre risque de réduire considérablement les possibilités d'échanges, même légaux
Sur les CD, des systèmes anticopie peuvent empêcher la duplication, mais aussi le transfert d'une chanson sur un baladeur numérique. Sur les sites de téléchargements payants, ils brident le nombre de copies et obligent l'usager à choisir des logiciels de lecture agréés. Ces verrous technologiques ?baptisés «mesure techniques de protection» ou systèmes de gestion des droits numériques (DRM, en VO)? sont au centre du projet de loi sur les droits d'auteur que l'Assemblée examinera les 20 et 21 décembre.
Transposition d'une directive européenne, le projet de loi suscite la colère d'une flopée d'associations, artistes, bibliothécaires et internautes, car il légitime en droit les DRM et les protège juridiquement: le fait de faire «sauter» un de ces DRM, quel qu'en soit le motif, pourra être puni de trois ans de prison et de 300.000 euros d'amende. En théorie, aucune circulation numérique d'?uvre non validée par les producteurs ou les éditeurs ne sera plus possible.
La contestation a été dopée par le calendrier : passé en Conseil des ministres il y a deux ans, le texte sera examiné à la veille de Noël et «en urgence», avec une seule lecture parlementaire. Et potentiellement des amendements imposant les DRM aux logiciels d'échange de fichiers, voire aux webradios. Une surenchère qui a suscité l'ire des concepteurs de logiciels libres dont la pétition contre «le verrouillage généralisé de la culture» a recueilli plusieurs dizaines de milliers de signatures. Ils voient là un cadeau aux fournisseurs de ces technologies de contrôle, dont Microsoft.
